OAKLAND, CA — Former Oakland Mayor Sheng Thao, her romantic partner and a pair of influential Oakland business owners all pleaded not guilty to a rash of federal corruption and bribery charges Friday.
Thao, her partner Andre Jones, David Duong and his son Andy were all named in a federal indictment that was unsealed Friday morning.
All four were subsequently arraigned in U.S. District Court in Oakland, where they entered their pleas, posted bail and were released.
"The indictment returned by the grand jury describes a corrupt scheme in which the defendant used bribes, mail fraud, wire fraud and other illegal practices to manipulate and corruptly influence the levers of local government," said Patrick Robbins, first assistant U.S. attorney for the Northern District of California.
"The public needs to know it can trust those in charge of City Hall to work for the best interests of the people of Oakland," Robbins said during a news conference from the U.S. Department of Justice offices in San Francisco prior to the arraignment. "This public trust is broken when elected officials agree to a pay-to-play system to benefit themselves."

The indictment comes about six months after a well-publicized FBI raid on the home Thao and Jones share in the Oakland hills and about two months after Oakland voters removed her from office in a recall election.
Properties belonging to the Duongs were also searched by the FBI, the IRS and the U.S. Postal Inspection Service on the same day as the raid on Thao's home.
The alleged scheme started around October 2022, just weeks prior to the November election Thao narrowly won, and involved $95,000 in four separate payments from the Duongs to Thao and Jones, according to federal prosecutors, who say an additional $205,000 was promised.
At Thao's direction, the money was allegedly paid to Jones for non-existent work he did for the Duongs' recycling company, California Waste Solutions.
In exchange, Thao allegedly agreed that the city would buy small modular homes from a Duong-owned company, extend a city recycling contract for another of their companies and appoint a high-level city official to benefit the Duongs' business interests.
In addition to the $95,000, the Duongs also allegedly bribed Thao by paying $75,000 for a negative campaign mailer targeting her political foes in the final days of the 2022 election. Thao's lawyer Jeff Tsai said Friday that the government's case is full of holes, his client is innocent of all charges and that the indictment came as a complete surprise given Thao's willingness to cooperate.
"There are numerous allegations that are made, but what is missing from this indictment is anything that truly indicates that the mayor had any involvement in the scheme that the government has described," Tsai said.
"From the beginning, the mayor has indicated that she is willing to sit down and cooperate with the government's investigation. That opportunity ultimately never arose," he said.
Andy Duong's lawyers released a statement following the arraignment saying their client is also innocent of all charges.
"We have kept quiet despite the media frenzy of the past months in the hope that the government would correctly come to see through objective investigation that the allegations are baseless, and being fanned by nothing more than gossip and supposition stitched together by the fabrications and delusions of those who lack all fundamental credibility," according to the statement sent on behalf of attorneys Winston Chan, Doug Sprague and Erik Babcock.
David Duong's lawyers released a statement saying he is innocent and is looking forward to proving so in a courtroom.
"Mr. Duong denies wrongdoing and will vigorously defend these allegations in court. He looks forward to prevailing in this case and continuing his decades of service, philanthropy, and devotion to our community and the Bay Area," according to the statement sent on behalf of attorneys Ed Swanson and August Gugelmann.
Jones declined to comment Friday but said he would make a statement at some point in the future. All four defendants are facing a variety of charges including conspiracy, wire fraud, mail fraud and bribery. In addition, Andy Duong is facing one count of making false statements to a government agent.
Thao and Jones are free on separate $50,000 bond agreements, while the Duongs are both free on a $100,000 bond each.
If convicted on all counts, they could each face roughly 90 years in prison and fines of more than $1 million.

(KRON) — The United States Attorney for the Northern District of California Department of Justice announced Friday that an Oakland man who operated a money wire transfer business has been sentenced for conspiracy to commit money laundering.
Jose Luis Garcia, 57, co-owner of Envios Express on the 3500 block of International Boulevard, was sentenced on Wednesday to 12 months in federal prison. Garcia was indicted in July 2023 and pleaded guilty in September 2024 to one count of conspiracy to commit money laundering, said the DOJ.
Garcia and his wife, Silvana Jorge de Oliveira aka “Dianne Johnson,” also charged in this case, operated the business under several names, according to court documents and Garcia’s plea agreement. The DOJ said Garcia had access to wire services that handled the transfer of funds from Oakland to other parts of the U.S., Mexico, Honduras, and other foreign countries.
The DOJ said Garcia admitted to “using fake sender names and IDs to process multiple structured wires to hide that a single sender was wiring amounts greater than $3,000, which he knew would have triggered mandatory federal reporting requirements.”
The DOJ said Garcia also accepted up to $9,000 “from unidentified customers, who asked that the cash be wired to well-known drug trafficking areas of Mexico or to persons in Honduras, without recording the true identity of the sender.” In order to dodge reporting requirements, the DOJ alleged that Garcia misused the names and IDs of real customers to wire money for fake customers.
According to the DOJ, Garcia also kept about 15,000 digital images of California driver’s licenses and Honduran, Mexican, and other national ID cards on cell phones, which he used to meet the wire companies’ ID standards.
The DOJ also alleges in August 2022 that Garcia “agreed to a request by an unknown source to wire $9,200 in cash to recipients in Mexico without providing an ID or using the sender’s real name, which is mandated by federal law.” Garcia distributed the $9,200 among four wires, using fake names as the sender on the receipts, and charged $50 under-the-table fee for each of the wires, said the Department of Justice.
In addition to the one-year prison sentence, Garcia was ordered to serve three years of supervised release, said the DOJ.

Oakland, CA – The City of Oakland has won a grant from Partnership for the Bay's Future (PBF) that will fund a two-year fellow to work in the Housing and Community Development (HCD) Department to support the development of lead hazard abatement and proactive rental inspection initiatives.
The award will assist in Oakland’s work to reduce lead hazards in older rental housing, especially in communities most impacted by housing instability. The City hired a consultant, Green and Healthy Homes Initiative, in 2024 to lead the technical aspect of the lead abatement work. By exploring the integration of lead hazard abatement with proactive rental inspections, the fellow’s work will aim to improve living conditions for families at risk of exposure and create safer homes for Oakland’s residents.
"We are grateful for the support of Partnership for the Bay's Future for this award," said Emily Weinstein, HCD Director. "Housing safety and habitability are top priorities for our work in the coming year, and this fellow will ensure specific attention is paid to creating equitable solutions.”
The fellow will be dedicated full-time for the next two years to facilitate collaboration between HCD, Planning and Building Department (PBD), and a coalition of community partners. The total benefit to City of Oakland is at least $675,800, of which $220,000 goes to a collaborative of community organizations to support the work.
The Healthy Havenscourt Collaborative brings essential community expertise to the project, connecting Oakland residents with resources and ensuring the program aligns with their needs. These partners will engage residents directly to shape the program and make sure their voices are central to its design and implementation. Coalition partners include Regional Asthma Management and Prevention (RAMP), La Clinica de la Raza, EBALDC, and Black Cultural Zone - all of which form the Healthy Havenscourt collaborative.

About Oakland’s Housing and Community Development Department
Homelessness and housing affordability are top priorities for Oakland residents. To address these challenges, the City is carrying out a multi-pronged approach. The Housing and Community Development Department is addressing housing affordability issues through its “3P” framework: Protect Oaklanders from displacement; Preserve the existing affordable housing stock; and Produce new, deeply affordable housing units. Oakland HCD also aims to prevent homelessness for vulnerable residents through partnerships with and grants to community service organizations. In 2024, the City of Oakland supported 1,542 units of affordable housing under construction, of which 55% (829) were for people exiting homelessness. The City of Oakland leverages funds from the State and Federal governments to maximize the impact of local dollars whenever possible.
